The Application of Article 169, numeral 6 of the Labour Code and the Infringementof the Right to Work in Guayaquil, Ecuador, 2020

Historically, the Labor Code in Ecuador has undergone changes and transformations, the arrival of the COVID-19 pandemic in 2020 caused serious effects on the labor sector and workers' labor rights, the present research aims to analyze the incidence of article 169, numeral 6 of the Labor Code, by evaluating its behavior in the pandemic, to determine the degree of vulnerability of labor rights in Guayaquil in 2020. The proposed objective and the designed methodology allow determining that 11.3 percent of the dismissals in Guayaquil, from March to August 2020, were due to the erroneous application of numeral 6 of article 169 of the Labor Code, which caused that
642 men and 496 women were thrown into unemployment, the age that most prevailed was between 30 and 40 years, the highest number of dismissals was of people with less than 10 years working, being Guayaquil the one that accumulates the highest number of dismissals with 963 cases , evidencing violation of the right to work. It concludes by stating that personnel should not have been fired for this article since it is not related to the pandemic.
